Bill Overview
Title: Southeast Asian Deportation Relief Act of 2022
Description: This bill prohibits the detention or removal of certain nationals of Vietnam, Cambodia, or Laos. Specifically, this protection from detention or removal shall apply to nationals of these countries who (1) entered the United States on or before January 1, 2008, (2) have continuously resided in the United States since entry, and (3) are subject to a final order of removal. Such individuals shall also receive employment authorization. The Department of Homeland Security must notify each individual covered by this bill, as well as information and instructions on how to file a motion to reopen removal proceedings.
Sponsors: Rep. Lowenthal, Alan S. [D-CA-47]
Target Audience
Population: People from Vietnam, Cambodia, and Laos facing deportation in the U.S.
Estimated Size: 15000
- The bill targets nationals from Vietnam, Cambodia, or Laos who are subject to a final order of removal.
- It specifies those who entered the U.S. on or before January 1, 2008, and have resided continuously in the U.S. since then.
- Various reports estimate tens of thousands of Southeast Asians in the U.S. are potentially affected by deportation proceedings.
- Historically, there have been significant communities of Vietnamese, Cambodian, and Laotian Americans due to post-war refugee resettlements in the U.S.
- Estimates from advocacy groups suggest that between 14,000 to 15,000 individuals might fall into the category of being subject to final orders of removal, but not all will meet all the criteria of this bill.
Reasoning
- The policy specifically targets a very niche group of people, which means most of the U.S. population will not be impacted.
- People already in stable jobs, stable immigration status, or outside the described demographics of the policy will see no impact.
- The policy aims to provide legal relief and integration support to a narrow set of Southeast Asian nationals, potentially improving their economic security and community stability.
- The budget allocated aims to cover legal processing, employment integration, and community support over the aimed period, considering the estimate of affected individuals and the administrative costs involved.
- The policy's anticipated effects will likely concentrate in areas with high populations of Vietnamese, Cambodian, and Laotian communities.
